Post of Junior Legal Officer/Legal Officer in the Department of
Industrial and Employment Relations, Ministry for Social Policy
*In accordance with clause 3.1 of the current Collective Agreement,
nomenclatures denoting the male gender include also the female
gender.
The Public Service Commission invites applications for the post of
Junior Legal Officer/Legal Officer in the Department of Industrial
and Employment Relations in the Ministry for Social Policy.
2.1 The salary for the post of Junior Legal Officer is €15,074 per
annum, rising by annual increments of €447.17 up to a maximum of
€17,757 (Salary Scale 9).
2.2 A Junior Legal Officer will progress to Scale 8 (€16,050 x
€486.83 - €18,971) on completion of two years service in the grade,
subject to satisfactory performance.
2.3 A selected applicant who has at least three (3) years of proven
legal practice after obtaining the warrant to practice as Advocate,
will be appointed as Legal Officer in Salary Scale 8 (€16,050 x
486.83 - €18,971). An officer in the grade of Legal Officer will
subject to satisfactory performance, be placed in Salary Scale 7
(€17,110 x 531.00 - €20,296) on completion of ten (10) years service
in the grade.
2.4
The appointees will be entitled to such other benefits and subject
to such other conditions as may be stipulated in any pertinent
agreement between the Malta Government and the competent Unions.
3.1 The appointment, which is subject to a probationary period of
one year, is on a full-time basis and is subject to the rules and
regulations governing from time to time the Malta Public Service in
general and the Department of Industrial and Employment Relations in
particular and involves liability to transfer according to the
exigencies of the Malta Public Service.
3.2 The appointee will not be allowed the private practice of
his/her profession.
4. The main duties of Junior Legal Officer/Legal Officer in the
Department of Industrial and Employment Relations include:
(a) Legal Enforcement section:
(i) Liaison closely with the Legal Enforcement Section in collating
the necessary evidence for cases to be presented as effectively as
possible in connection with the enforcement of the Employment &
Industrial Relations Act;
(ii) Filing of judicial letters, garnishee orders, warrants of
seizure, execution of Court judgments and other acts;
(iii) Representing the Department of Industrial and Employment
Relations and presenting its submissions on enforcement and other
actions in Court to protect Government’s interests at law;
(iv) Tendering legal advice to the Department of Industrial and
Employment Relations on enforcement and other action and on
enforcement issues and representing the Department of Industrial and
Employment Relations at hearings in Court;
(b) Technical Section:
(i) Drafting the necessary amendments to the Act or Legal Notices
relating to the Department of Industrial and Employment Relations;
(ii) Drafting legal notices and exemptions;
(iii) Giving advice on problems of interpretation and technical
issues;
(iv) Representing the Department on relevant issues related to the
Department abroad;
(v) Performing other work related to the Department as may be
indicated by the Director;
(c) The Junior Legal Officer/Legal Officer would need to keep
abreast with relevant provisions of the Code of Organisation and
Civil Procedures, the Civil Code and other laws which have a bearing
on Industrial and Employment Relations and will also be responsible
for appearing for the Department before other courts when the
Director of Industrial and Employment Relations is summoned as a
witness.
5.1 By the closing time and date of this call for applications,
applicants must be:
(a) (i) citizens of Malta;
Or
(ii) citizens of another European Union Member State;
Or
(iii) citizens of other countries to which the EU provisions on free
movement of persons apply (In case of difficulty the Ministry of
Foreign Affairs is to be consulted regarding the countries to which
EU provisions apply);
Or
(iv) the spouse and children, even if they are third country
nationals, of any person mentioned at (i), (ii) and (iii) above,
provided they are eligible to work in Malta under current
legislation. This should be determined with the advice of the
Director, Citizenship and Expatriate Affairs, Ministry of Foreign
Affairs.
The appointment of candidates referred to at (ii), (iii) and (iv)
above would necessitate the issue of an employment license in so far
as this is required by the Immigration Act and subsidiary
legislation.
(b) (i) in possession of the warrant to practice the profession of
Advocate in Malta;
Or
(ii) persons having the academic qualifications to obtain such a
warrant;
(c) able to communicate in the Maltese and English languages;
(d) of good moral character (applicants who are already in the Malta
Public Service must produce a Service and Leave Record Form (GP 47);
those applying from outside the Malta Public Service must produce a
recent Certificate of Conduct issued by the Police or other
competent authority not earlier than six (6) months from the date of
this call for applications and state whether they have ever been in
the Malta Government Service, giving details).
5.2 Successful applicants under paragraph 5.1 (b) (ii) will only be
considered if there are not enough suitable applicants under
paragraph 5.1 (b) (i). Such applicants, moreover, will only become
appointable when they obtain the warrant to practice as Advocates in
Malta and provided that a vacancy is available.
6.1 Persons registered with the National Commission for Persons with
a Disability (NCPD) may be given reasonable accommodation in terms
of Article 7 of the Equal Opportunities (Persons with Disability)
Act, (Cap. 413), even if they do not satisfy in full the eligibility
requirements for this post provided they can carry out, in essence,
the duties related to the post and subject to the concurrence of the
Management and Personnel Office and approval of the Public Service
Commission.
6.2 Representations in terms of this clause should be attached to
the application forms and supported with relevant documents which
must also include documentary evidence of registration with the NCPD.
Reasoned justifications should be given to substantiate the lack of
full eligibility requirements and why reasoned considerations are
merited. All correspondence is to be addressed to the receiving
Department and copied to the NCPD.
7.1 Qualifications and experience claimed must be supported by
certificates and/or testimonials, copies of which should either be
attached to the application or sent separately to the receiving
Department by note later than ten (10) working days from the closing
date. Scanned copies sent electronically are acceptable.
7.2 Original certificates and/or testimonials are to be invariably
produced for verification at the interview.
7.3 It is the responsibility of applicants, in possession of
qualifications awarded by foreign Universities/tertiary education
institutions, to produce a recognition statement on comparability of
qualifications issued by the Malta Qualifications Recognition
Information Centre (MQRIC) within the Ministry of Education,
Culture, Youth and Sport or the designated authority, as applicable,
which statement should be attached to the application and the
original presented at the interview. Candidates not in possession of
this statement may still apply, provided that they submit a copy of
the statement, issued by the pertinent authority, to the receiving
department as soon as available and, in any case, by not later than
one month from the closing date of the call for applications.
8.1 Eligible applicants will be requested to attend for an interview
by a Selection Board to assess their suitability for the post.
8.2 The result of the interviews will be published by the Public
Service Commission and exhibited on the notice board of the Office
of the Public Service Commission and that of the Department of
Industrial and Employment Relations, Ministry for Social Policy.
8.3 A notification of the issue of the result will be duly published
in the Government Gazette and will also appear on the website of the
Public Service Commission where it may be accessed
at http://www.psc.gov.mt.
A press notice will also be issued to all local media organisations.
8.4 Petitions objecting to the result in terms of Section 1.1.10 of
the Public Service Management Code should be submitted within ten
(10) working days from the date of publication of the notice in the
Government Gazette.
9. The selected candidate will be medically examined to ascertain
that he/she is fit for the post.
10.1 The selected candidate may also be required to travel abroad to
attend meetings/conferences.
10.2 When proceeding abroad to follow meetings/conferences he/she
will be bound by the relevant conditions laid down in the Public
Service Management Code.

2008, may be considered provided that all requisite details are
given. The formal application duly signed by the applicant must
reach the Department of Industrial and Employment Relations in the
Ministry for Social Policy by not later than one week after the

14. (a) Applications delivered by hand will be acknowledged in
writing by the Director, Industrial and Employment Relations and a
receipt will be given in hand at the time of delivery.
(b) Applications by post should be sent by registered mail in

applications will be acknowledged in writing by the Director,
Industrial and Employment Relations within seven (7) days.
